1. Acceptance of Terms

By accessing or using BugBrain's AI-powered autonomous testing platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

BugBrain provides an AI-powered testing automation platform that enables users to:

  • Generate automated test cases using artificial intelligence
  • Execute end-to-end tests across UI, API, and database layers
  • Utilize self-healing automation to reduce test maintenance
  • Access cloud-based test execution infrastructure
  • Analyze test results and identify bugs

3. User Accounts

3.1 Account Registration

To use our Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access
  • You must not share your account credentials with third parties
  • You must comply with all applicable laws when using our Service

4. Subscription, Trials, and Payment

4.1 Free Trial with Card Requirement

Important Billing Information: When you start a free trial, you are required to provide your payment method (credit or debit card). By providing your payment information and starting your trial, you authorize BugBrain to:

  • Charge your payment method at the end of the trial period unless you cancel before the trial ends
  • Securely store your payment information for recurring billing
  • Automatically charge you the subscription fee when your trial period expires

4.2 Trial Terms

  • Trial Duration: Free trials are typically 14 days from the date you add your payment method
  • No Charge During Trial: You will not be charged during your trial period
  • Trial End Date: You will be notified of your exact trial end date when you start your trial
  • Email Reminders: We will send you email reminders at 7 days, 3 days, and 1 day before your trial ends
  • Cancellation: You may cancel at any time before your trial ends to avoid charges
  • Automatic Conversion: If you do not cancel, your trial will automatically convert to a paid subscription
  • First Charge: Your first charge will occur immediately after your trial period ends

4.3 Subscription Plans

BugBrain offers various subscription plans (Starter, Pro, Business) with different features and usage limits. Subscription fees are billed in advance on a monthly or annual basis.

4.4 Payment Terms

  • All fees are exclusive of applicable taxes unless stated otherwise
  • Payment is due upon subscription start or renewal
  • We accept major credit cards and debit cards via Polar.sh
  • Failed payments may result in service suspension after grace period
  • You are responsible for providing accurate payment information
  • You must update your payment method if it expires or becomes invalid

4.5 Auto-Renewal and Cancellation

Automatic Billing: Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings under Billing.

  • How to Cancel: Navigate to Settings → Billing → Cancel Subscription
  • Access After Cancellation: You retain access until the end of your current billing period
  • No Refunds: Subscription fees are non-refundable except as required by law
  • Trial Cancellation: If you cancel during your trial, you will not be charged

4.6 Price Changes

We reserve the right to change our subscription prices. We will notify you at least 30 days before any price changes take effect. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.

5. Refund Policy

  • Trial Period: No refunds are necessary as you are not charged during the trial
  • First Payment: If you believe you were charged in error, contact us within 7 days
  • Ongoing Subscriptions: Generally non-refundable, except as required by law
  • Service Issues: We may offer prorated refunds for significant service outages

6. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to our systems
  • Use the Service to transmit malware or harmful code
  • Reverse engineer, decompile, or disassemble the Service
  • Resell or redistribute the Service without authorization
  • Use the Service to test third-party applications without proper authorization

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in the Privacy Policy. By using our Service, you consent to our data practices.

8. Intellectual Property

8.1 Our Intellectual Property

BugBrain and its original content, features, and functionality are owned by BugBrain and are protected by international copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of test data, configurations, and content you create using our Service. By using our Service, you grant us a license to use, store, and process your content to provide and improve the Service.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice)
  • Emergency maintenance
  • Technical difficulties or infrastructure issues
  • Circumstances beyond our reasonable control

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUGBRAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
